Sexual Harassment at workplace is a gender-based discrimination and violation of constitutional rights. It is expected that all employees coming for work need safe place to work. With more and more female employees working at workplace, they need safe environment where they can work without fear and find no bias. It was long felt by the Government of India that there is a need of proper legislation which can protect women employees. Finally POSH Act (Prevention of Sexual Harassment) 2013 was promulgated. The role of HR has increased in terms of understanding the whole act , guiding management about their roles and responsibilities , giving awareness to employees and implementing the said act sincerely. Although the act has come into force in the year of 2013, December. But many private organizations avoid this law to be present in the organization and in most cases paper and pen applications are there. Employer does not know what they should do? What should be communicated to make workplace safe? What will be the penalty in case of any incident therein the organization? Even there is no intimation of this Act and what women employees will do in case any incident occurs. Under the above situation, the workplace remains a place of predator. It makes environment toxic and efficient women employees suffer under stress, become mentally ill and finally search for a better place for work. HR therefore should take active role from counseling to employer and employees, implementing the Act and make the workplace engaging. The abstract of the Act should be prominently available and accessible to all employees. There should be committee where women employees can inform incidents. Employees should know time limit of lodging complain ? Again preventing part is also important . HR should start this action from onboarding so that all new joiners should know and get confidence. Existing employees should get awareness training so that HR can create harassment free work environment. Actually concealing and avoiding any acts do not make workplace healthy. It is openness and awareness to all can make workplace free from fear. Here HR should take active role.
